Terms and conditions of the online shop Piece of Mind
I. General provisions, contact with the owner of the shop
1. These regulations (hereinafter referred to as ‘Regulations’) define the terms and conditions of using the Piece of Mind online shop, operating at the web address https://pieceofmindpuzzles.pl.
2. The shop is owned by Patrycja Podraza, entrepreneur conducting business under the name of Patrycja Podraza. Piece of Mind with the registered office at: ul.Czerniakowska 159/46, 00-453 Warsaw, registered in the Central Register of Business Activity and Information, NIP: 6443404018, REGON: 541298934 (hereinafter referred to as ‘Seller’).

II. Technical requirements
1. In order to use the Shop it is necessary to have:
i. a computer or other device with an Internet browser;
ii. access to the Internet;
iii. an active e-mail address.
III. Personal data
1. The administrator of personal data of the Shop's customers is the Seller.
2. All information about processing of personal data of customers as well as other persons using the Shop's website can be found in the Privacy Policy.
IV. Conclusion of a sales contract, customer account
1. The Shop allows for the purchase of goods (hereinafter referred to as ‘Goods’), displayed on the Shop's website, in two modes:
i. without registration;
ii. with the creation of an account in the Store.
In both cases, in order to place an order, you need to select the Goods in the Store, add them to the ‘Basket’ with the appropriate button and continue the ordering procedure by selecting the relevant options (delivery and payment method).
2. Information about the products in the Store, i.e. descriptions and prices, constitute an invitation to conclude a sales agreement within the meaning of Article 71 of the Civil Code, in accordance with the terms and conditions of the Terms and Conditions.
3. Placing an order is conditional on filling in the order form with all the required data necessary to perform the contract and possibly (at the customer's request) also with data to generate a VAT invoice.
4. If the customer decides to create an account in the Shop (hereinafter referred to as ‘Account’), registration is one-time and the e-mail address and password chosen by the customer are the basis for subsequent logging in. Details of the provision of the digital Account service by the Seller are available below in the Account Terms and Conditions. After logging into the Account, the customer has access to his/her order history and does not have to fill in the order form again with his/her personal data for subsequent orders.
5. The customer can cancel the account at any time at no cost. To do so, please send your cancellation to the e-mail address: shop@pieceofmindpuzzles.pl.
6. Confirmation of the order by the customer with the ‘I buy and pay’ button (or any other equivalent wording) means:
a. submitting to the Seller an offer to purchase the Goods in accordance with the options selected in the order and in accordance with these Terms and Conditions,
b. acceptance of the obligation to pay the price of the Goods and the cost of their delivery.
7. The conclusion of the contract of sale (hereinafter the ‘Contract’) occurs at the moment of acceptance of the order by the Seller for processing (acceptance of the customer's offer), of which the Seller informs by e-mail with confirmation of acceptance of the order for processing.
8. If it is not possible to fulfil the order of Goods (in whole or in part), the Seller shall inform the customer about it - the Contract is not concluded then. At the same time, the Seller shall inform the customer of the existing possibilities of other order processing, e.g. partial processing of the order or waiting for the Seller to replenish the stock. If an order has been previously paid for by the customer and it is not possible to fulfil it, the Seller shall immediately return the payments made to the customer (according to the extent of the order cancellation). ;
9. The Seller shall provide the customer with a confirmation of the conclusion of the Contract on a durable medium at the latest at the time of the delivery of the Goods.
10. The shop is not responsible for non-delivery of an order or a delay in its delivery resulting from the customer providing an incomplete / incorrect delivery address or failing to provide other data necessary for the order to be processed.
11. The Seller reserves the right to suspend the execution of an order in a situation where the customer has provided false data or where the data raises reasonable doubts as to its correctness. In such a case, the Seller (if possible) will attempt to contact the customer to verify the accuracy of the data provided.
V. Prices and payment methods
1. The prices of the Goods are given in the Polish zloty (PLN) and in the gross amount, i.e. including VAT.
2. The cost of delivery of the Goods is given separately in the basket of the Store, depending on the method of delivery chosen by the Customer.
3. The available payment methods are described on the Shop's website in the ‘Forms of payment’ tab and are presented to the customer at the stage of placing the order (in the shopping basket).
4. The Shop offers the following payment methods:
a. traditional bank transfer to the Seller's account
b. quick electronic transfer / BLIK / payment with the so-called virtual wallet - through a payment platform:
· Shoper Payments Przelewy24 - PayPro S.A.
c. payment by card: Visa, Visa Electron, MasterCard, MasterCard Electronic
d. cash on delivery (cash on delivery)
5. If the customer has chosen to pay by ordinary bank transfer, payment for the order should be made within 1 day of its placement. If payment is not made within the aforementioned period, the Contract shall be deemed not to have been concluded.
If Shoper Payment is selected, the entity providing online payment services and payment card payments (Visa, MasterCard) is PayPro S.A and/or Autopay S.A..
VI. Delivery of goods
1. The delivery of Goods takes place at the customer's choice:
· via courier
· to InPost parcel machines
· via ORLEN parcel
· personal collection
2. The customer may also collect the order:
a. personally at the Seller's premises
3. With the exception of Goods collected by the customer in person, an order is deemed to be fulfilled when the consignment is dispatched to the customer (entrusted to a carrier offering transport services). The exact actual delivery date is determined by the carrier.
4. Goods are dispatched by the Seller within 4 working days, unless a different deadline is clearly indicated in the product description when the customer places an order. Detailed lead times are given on the Shop website and/or the Seller will give them in an individual message addressed to the Customer.
5. As a standard, the Seller handles orders within the territory of the Republic of Poland at costs indicated on the Shop website under ‘Delivery time and costs’. Shipping abroad is possible against payment of the costs indicated on the website of the Store or the costs individually agreed upon with the Customer.
VII. Withdrawal from the contract
1. The customer who is a consumer or an entrepreneur referred to in Article 7aa of the Consumer Rights Act (hereinafter referred to as the ‘Privileged Entrepreneur’) has the statutory right to withdraw from the contract of sale of the Goods within 14 days of its receipt, without giving any reason, subject to the exceptions referred to below.
2. In order to meet the deadline for withdrawal it is sufficient for the customer to send, within the aforementioned period, a statement:
· in electronic form to the address: shop@pieceofmindpuzzles.pl or
· in written form to the address: ul.Czerniakowska 159/46, 00-453 Warsaw.
3. The declaration of withdrawal from the contract may be submitted according to the specimen available here, however the use of the specimen is not obligatory. The Seller shall immediately send the customer an e-mail confirmation of receipt of the statement of withdrawal.
4. Then, within the next 14 days, the customer should send back the returned Goods at their own expense to the postal address ul. Czerniakowska 159/46, 00-453 Warsaw.
5. The Seller shall promptly, but not later than within 14 days from the receipt of a declaration of withdrawal from the contract, refund to the customer:
· the price of the Goods;
· the cost of the initial shipment of the Goods to the customer according to the cheapest ordinary way of delivering the goods, offered in the Store.
6. The Seller may refrain from refunding the payment until it has received the Goods back, or at least the customer has provided the Seller with proof of having sent the item back.
7. We will refund the payment using the same means of payment that were used by the customer in the original transaction, unless the customer has expressly agreed otherwise.
8. The customer shall be liable for any diminished value of the returned Goods if, prior to the declaration of withdrawal, the customer has used the Goods in a manner other than that necessary to establish the nature, characteristics and functioning of the thing.
VIII. Exceptions to the right of withdrawal from the contract of sale of Goods
1. The right of withdrawal shall not apply to Contracts for the supply of Goods:
a. non-refabricated, made to the consumer's /privileged trader's specifications or intended to meet his/her individual needs (personalised goods);
b. perishable or with a short shelf life (perishable goods);
c. goods supplied in sealed packaging where the packaging has been opened by the customer and the goods cannot be returned for health or hygiene reasons after opening the packaging (hygienically packed goods);
d. sound or visual recordings or computer programs supplied on a tangible medium (e.g. CD) in a sealed package; . CDs) in sealed packaging if the packaging is opened after delivery;
e. which after delivery are, by their nature, inseparable from other goods (e.g. building materials, if used);
f. daily newspapers, periodicals or magazines, with the exception of a subscription contract (paper newspapers);
g. whose price depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the expiry of the deadline for withdrawal from the contract;
h. alcoholic beverages, the price of which has been agreed upon at the conclusion of the sales contract, the delivery of which may only take place after 30 days and whose value depends on market fluctuations over which the Seller has no control.
IX. Complaints
1. The Seller is obliged to provide the customer with Goods conforming to the Contract.
2. Towards consumers and Privileged Entrepreneurs, the Seller shall be liable for the conformity of the Goods in accordance with the provisions of the Consumer Rights Act. Towards other customers, the Seller bears liability according to the provisions of the Civil Code.
3. Complaints can be submitted:
· in electronic form to the address: shop@pieceofmindpuzzles.pl
· or in writing to the address: ul. Czerniakowska 159/46, 00-453 Warsaw, Poland.
4. The Seller shall consider the complaint in the form in which it was submitted (in writing or by e-mail) within 14 days of receiving the complaint.
5. In the case of dissatisfaction with the way the complaint is handled by the Seller, the consumer and the Privileged Entrepreneur may (in addition to the ordinary proceedings before the common court) also use the out-of-court ways of handling complaints and pursuing claims.
6. For this purpose, you can:
i. apply to a provincial inspector of the Trade Inspection to initiate mediation proceedings for the amicable settlement of a dispute,
ii. use the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection,
iii. apply to a permanent amicable consumer court to resolve a dispute arising from the concluded agreement,
iv. use the ODR (Online Dispute Resolution) platform for online dispute resolution between consumers and traders if the dispute concerns obligations arising from a contract concluded online. More information about the ODR platform can be found here. Please note that this platform does not accept new complaints as of 20 March 2025, and its functioning will end on 20 July 2025.

X. Final provisions
1. Polish law applies to Contracts concluded in the Shop. The Contract is concluded in the Polish language.
2. None of the provisions of the Terms and Conditions does not exclude or in any way restrict the rights of the consumer (and the Priority Entrepreneur) resulting from the provisions of the law.
3. The Seller may make changes to the Terms and Conditions at any time, with such changes applying to orders placed after the publication of the new version of the Terms and Conditions, and in the case of (i) previously concluded Digital or Electronic Service Agreements and (ii) customers with an Account in the shop - the customer will be notified of the change to the Terms and Conditions and the possibility of not accepting the new content.
4. The Terms and Conditions are effective as of 28-05-2025.
Rules and Regulations of the Account in the Piece of Mind shop
I. General provisions, contact with the Seller
1. These Account Rules (‘Account Rules’) define the rules and conditions of using a customer's account (“Account”) in the Piece of Mind online shop (‘Shop’).
2. These Account Terms and Conditions constitute the terms and conditions of the electronic service within the meaning of the Electronic Services Act. The Account service is an additional and secondary service to the main activity of the Seller, i.e. offering the purchase of Goods to customers. The Account service is free of charge.
3. The Account Regulations supplement the Shop Regulations. To the extent not regulated in the Account Regulations, the provisions of the Shop Regulations apply to this service.

II. Technical requirements and functionalities of the Account service
1. The technical requirements for the use of the Account service are the same as for the use of the Shop and are indicated in point II.1. of the Rules and Regulations of the Shop.
2. By using an Account, the Shop Customer has the possibility:
a. to save and store his/her personal data (including the delivery address) in the Account, which makes it possible to make further purchases in the Shop without the need to fill in the address form again,
b. to view the history of his/her orders,
c. to view the status of order completion.
III. Contract for the provision of the Account service, withdrawal from the contract, resignation from the Account
1. The creation of an Account by the customer is tantamount to concluding a contract for the provision of electronic services for an indefinite period of time. The customer may resign from having an Account at any time without stating a reason. To do so, the Customer must contact the Seller electronically at shop@pieceofmindpuzzles.pl. The Customer also has the statutory right to withdraw from the contract for the provision of the Account service within 14 days of its conclusion.
IV. Complaints
1. Towards consumers and Privileged Entrepreneurs, the Seller shall be liable for the conformity of the Account service with the contract in accordance with the provisions of the Consumer Rights Act. Towards other customers, the Seller shall be liable according to the principles of the Civil Code.
2. Complaints regarding the Account service may be submitted to the Seller in accordance with the procedure provided for in points IX. 3-5 of the Rules and Regulations of the Store.
3. In case of dissatisfaction with the way a complaint is handled by the Seller, it is also possible to use out-of-court ways of handling complaints and claims, in accordance with the procedure described in points IX. 6-7 of the Shop Regulations.
V. Personal data
1. Full information on the processing of personal data of the Store's customers, including for the purposes of maintaining the Account, is provided in the Privacy Policy.
VI. Changes to the Account Terms and Conditions
1. Seller may make changes to these Account Terms and Conditions under the terms indicated in point X. 3 of the Shop Rules. If the customer does not accept the new wording of the Account Terms and Conditions, he/she may terminate the agreement for the provision of the Account service (by contacting the Seller electronically for this purpose) with 14 days' notice.
