I. COOKIES AND OTHER TECHNOLOGIES

We use cookies and other similar mechanisms to learn how users use our Website and for marketing purposes, including to display advertisements to them elsewhere on the Internet.

# What are cookies?
A cookie is a small text file which is stored by a website on your computer, phone or other device on which you browse a website. The cookie contains data about your use of the website.

Some cookies are essential for the operation of our Shop and cannot be disabled.
In other cases, the first time you visit our Website, we ask you to agree to the installation of cookies. We do not use advertising or analytics cookies (or any other non-essential cookies) without your consent.

# What cookies do we use?

I. Essential cookies

  • These cookies are used to make the website work properly. You cannot deactivate them because if you disable them, our website will simply not function properly.
  • In this respect, we use a tool that stores your privacy settings. It shows your consent or lack thereof to the running of particular types of cookies on our website.
  • Other necessary cookies on our Website are used for the correct functioning and management of our Website, including for making changes to the Website and for running tracking tools that you agree to.

II. Functional cookies

  • Some of the cookies on our Website are used to launch additional tools on the Shop website, such as chat, the module for adding product reviews and/or stars, the possibility to recommend a product to a friend, the possibility to show you the products you have recently viewed in our Shop, etc.
  • You will find a list of the functional tools we use on the Website, together with an explanation of what exactly they are used for, in the cookie consent management panel.

III. Social media plug-ins and links

  • We have included links to our social media profiles on our Website: Instagram. If you visit our profile on a particular service, the owner of this service will be informed - as when users go from any other website to another website - that you have reached these services from our Shop.
  • You can find details of the processing of your data by these social media sites on the pages of the providers of these sites:
                  Facebook and Instagram - https://www.facebook.com/privacy/center/

Videos

  • Some videos on the Website are embedded using plugins from YouTube [a service owned by Google] / plugins from Instagram [owned by Meta Platforms]. When you play such videos on our Website, Google / Instagram receives information about this from your browser, even if you do not have a Google/YouTube profile / even if you do not have a profile on Instagram or are not currently logged in. If you have previously logged in to the aforementioned service, this service provider will be able to directly assign the video playback to your profile.
  • If you wish to prevent Google / Instagram from collecting information about your activity on our Website, you can:

- not play the video (We will treat your consent to play the video as consent that also applies to other videos on our Website - until you revoke it, i.e. change your cookie choices),

- not consent to cookies from this service on our Website,

 - or you can log out of this service.

# Legal issues relating to cookies

The legal basis for the Shop's use of essential cookies (indicated above under ‘What cookies do we use?’) is our legitimate interest, i.e. the right to operate the Website to support our business, and the need to maintain its security.
The legal basis for our use of other cookies is your consent.

In connection with our processing of your personal data by means of cookies, you have rights at any time, which we write about below.

Our use of cookies, in particular for advertising purposes, may involve so-called profiling. This means that we, or the marketing companies we use, may create a profile of you on the basis of the information collected (e.g. email address, order history, type of device, technology used, frequency of visits) and, on this basis, formulate purchasing forecasts for the future. This allows us to decide what content (including advertising) to display on our and other websites.

# How long do cookies remain on your device?

It depends on whether they are ‘persistent’ or ‘session’ cookies. Session cookies, i.e. information necessary for the browser functionalities to work correctly, expire at the end of the user session, i.e. each time you close our Website. Persistent cookies that make the use of the Site easier (e.g. remembering the selected resolution, content layout, user preferences, last viewed products) will be stored for longer by your browser and will remain there until the expiry date, unless you delete them first using the settings in your browser menu.

Cookies from third parties (i.e. analytics, advertising and social media-related cookies) are subject to their own privacy policies, to which we provide you with links in this policy.

II. Other purposes for processing the personal data of Shop users

# What data do we process and for what purposes?

In addition to the cookies described above, we process the following your data for the following purposes related to the operation of the Shop:

It is not obligatory for you to provide the above data, but it is necessary in order to process your order, invoice you, notify you of the status of your order, respond to your enquiry or complaint, etc.

# How long do we process data?

We will process your data related to your order in the Shop for as long as it is necessary for the fulfilment of your order, as well as according to accounting and tax regulations.

In addition to this, we will process your data for as long as necessary to achieve the purposes listed in the table above (and therefore until our legal interest enabling us to process ceases, or until you object to the processing, or until you withdraw your marketing consent - if you have given us one). Further processing will only be possible if we, as a controller, are under a legal obligation to do so (in particular for tax purposes) and possibly for archival purposes to protect ourselves against possible claims (until the statute of limitations for such claims).

# To whom do we share your data?

In our business we use the services of other cooperating companies, so your data may be entrusted by us: the company providing us with the software to run the Shop, the accounting company, the host of our Website, the host of our e-mail, other companies whose services and marketing tools we use. Your data is also passed on to courier companies and payment intermediaries, if any, for the purpose of processing your order, these companies being separate controllers of your personal data.

For the purposes of the marketing activities described above under ‘Cookies’, we use services provided by US-based entities (Google, Facebook). Accordingly, personal data may be transferred to third countries which are not members of the European Union. An adequate level of protection for your data in this regard is provided by the Data Privacy Framework, which you can read more about here.

# Your rights in relation to data processing

We are committed to respecting the confidentiality of your personal data and to ensuring that you can exercise your rights. You can exercise your rights at no cost to you by emailing us or otherwise contacting us.

Remember that in relation to the processing of your data you have the right to:

  • request us to access the data we hold about you;
  • to rectify your data;
  • to erase your data if it is no longer needed for the purposes for which it was processed or we have no other legal basis for processing it;
  • to withdraw your consent to the processing of your personal data, if you have given it;
  • to object to the processing of your data if we are processing it on the basis of a legitimate interest;
  • to restrict the processing of your data;
  • to lodge a complaint with the President of the Personal Data Protection Authority if you believe that your data is being processed by us unlawfully.

APPENDIX 1 TO THE PRIVACY POLICY OF THE Piece of Mind STORE
- LIST OF ADVERTISING AND ANALYTIC TOOLS USING COOKIES

I. ANALYTIC COOKIES:

1. Cookie files of the software provider of our Store

  • The software provider through which our Store operates - i.e. the owner of the shoper.pl platform - places cookie files on our Site in order to collect aggregate information on how customers use the online shop (sub-pages opened and time spent on them, products displayed, clicks on the Store's website, analytical information on purchases, e.g. conversion rates).
  • This data is used to create aggregate reports for e-shop owners, containing general (no personal data) information on e.g. what products the shoppers are interested in, at what time of the year there is an increase in shop traffic or sales, etc. This allows retailers (including us) to improve their shops and optimise their sales processes.
  • You can read the full details in the Cookie Policy for Shoper shop visitors.

Legal basis:

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO).
